Terms of Service

These Terms of Service govern your use of the Abracode platform, operated by GBS Tecnologia da Informacao Ltda, CNPJ 44.000.992/0001-22. By creating an account or using the service you agree to these terms.
1. The service
Abracode is a software-as-a-service platform that helps businesses connect to and operate the official WhatsApp Business Platform (Meta Cloud API), including guided onboarding, a managed API and dashboard for sending and receiving messages, template management and health monitoring.
2. Accounts
You must provide accurate information, keep your credentials secure and are responsible for activity under your account. You must have authority to bind the organization you register.
3. Customer responsibilities
You are the data controller for the personal data in the messages you send and receive. You are responsible for having a valid legal basis, obtaining any required opt-in for marketing, complying with the LGPD, the WhatsApp Business Messaging Policy and the WhatsApp Business Terms, and for the content of your messages and templates.
4. Acceptable use
You may not use Abracode to send spam or unlawful, misleading or abusive content, to violate any third-party rights, or to attempt to disrupt or gain unauthorized access to the service.
5. Fees
You pay Abracode for the software under your selected plan. WhatsApp messaging fees are billed by Meta directly to you and are passed through with zero markup. Software fees are non-refundable except where required by law.
6. Third-party platforms
The service depends on the WhatsApp Business Platform and other providers. Your use is also subject to their terms and policies, and we are not responsible for their acts, outages or changes.
7. Availability
We work to keep the service available and reliable but provide it "as is" without warranties except those that cannot be excluded by law. Specific availability commitments, if any, are set out in a separate agreement.
8. Limitation of liability
To the extent permitted by law, Abracode is not liable for indirect, incidental or consequential damages, and our aggregate liability is limited to the software fees you paid in the twelve months before the event giving rise to the claim.
9. Termination
You may stop using the service at any time. We may suspend or terminate access for breach of these terms or misuse of the service. On termination we handle your data as described in the Privacy Policy.
10. Governing law
These terms are governed by the laws of Brazil, with venue in the courts of Brazil, unless otherwise agreed in a signed contract.
